TERMS OF USE - HORIZON JOB CONNECT

1. AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "Employer," or "Job Seeker") and Horizon Job Connect ("we," "us," or "our"), concerning your access to and use of the horizonjobconnect.com website (the "Site"). By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. NATURE OF SERVICES (ADVERTISING VENUE ONLY)
2.1. Passive Conduit:
You acknowledge that Horizon Job Connect acts solely as a passive conduit for the online distribution and publication of user-submitted content. We are not an employment agency, staffing firm, or employer with respect to the use of the Site.
2.2. No Endorsement:
We do not screen or censor the listings, including profiles offered. We are not involved in the actual transaction between employers and candidates. As a result, we have no control over the quality, safety, or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates, or the ability of candidates to fill job openings.
3. USER REPRESENTATIONS & WARRANTIES
By using the Site, you represent and warrant that:
- Accuracy: All registration information you submit will be true, accurate, current, and complete.
- Legal Capacity: You have the legal capacity and you agree to comply with these Terms of Use.
- Compliance with Law: Your use of the Site will not violate any applicable law or regulation, including Canadian Human Rights laws, PIPEDA, and provincial Employment Standards.
4. EMPLOYER OBLIGATIONS (SPECIFIC)
4.1. Bona Fide Opportunities:
Employers warrant that all job postings represent genuine, currently available employment opportunities. "Bait and switch" advertising is strictly prohibited.
4.2. Regulatory Compliance (LMIAs/PNP):
Employers utilizing this Site for the purpose of meeting Service Canada (ESDC) or Provincial Nominee Program (PNP) advertising requirements acknowledge that Horizon Job Connect does not guarantee the success of any immigration application. It is the sole responsibility of the Employer to ensure their advertisement meets the specific content, duration, and reach requirements of the relevant government program.
4.3. Prohibited Content:
You may not post jobs that require an upfront investment from the candidate, relate to multi-level marketing (MLM), or contain discriminatory criteria (e.g., specifying race, gender, or religion) unless a specific legal exemption applies (e.g., bona fide occupational requirement).
5. FEES AND PAYMENTS
5.1. Payment:
Employers agree to pay the fees associated with the job posting packages selected. All fees are in Canadian Dollars (CAD) unless otherwise stated.
5.2. Refund Policy:
All sales of job posting packages and advertising services are final and non-refundable, except where required by law.
5.3. Price Changes:
We reserve the right to change our pricing at any time. Any price changes will apply to subsequent purchases and will not affect active job postings.
6. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
7. PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to:
- Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory (e.g., "scraping" resumes) without written permission from us.
- Using the Site to advertise or offer to sell goods and services other than legitimate employment opportunities.
- Circumventing, disabling, or otherwise interfering with security-related features of the Site.
8. SITE MANAGEMENT & TERMINATION
We reserve the right, but not the obligation, to:
- Monitor the Site for violations of these Terms of Use.
- Request verification documents from Employers (e.g., business license, CRA documents) to ensure the legitimacy of the posting entity.
- Refuse Service: We reserve the right to refuse service, terminate accounts, and remove or edit content (including job postings) in our sole discretion, particularly if we believe an Employer is posting fraudulent or non-compliant content.
9. LIMITATION OF LIABILITY
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site. We explicitly disclaim any liability for hiring decisions made by users of the site.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your contributions to the Site or your violation of these Terms of Use.
11. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms of Use at any time. All changes will be effective immediately upon posting to the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use.
12. SEVERABILITY
If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
13. GOVERNING LAW
These conditions are governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada.
